"The Content of the Right to Internet Access",

Having internet access is essential for the full enjoyment of many human rights. Therefore, this Article aims to determine the minimum essential content of the right to the internet in order to both understand the extent to which it deserves protection and to verify compliance with the obligations it entails. We describe the evolving nature of internet and broadband access due to technological developments and social needs. We also present the different positions regarding internet access as a human right or not, as well as how this right is acknowledged in the Mexican Constitution.
Tener acceso a internet es fundamental para el pleno disfrute de muchos derechos humanos. Por ello, este artículo tiene como objetivo determinar el contenido mínimo esencial del derecho a Internet, para comprender hasta qué punto merece protección así como para verificar el cumplimiento de las obligaciones que conlleva. Describimos la naturaleza evolutiva del acceso a Internet y banda ancha debido a los desarrollos tecnológicos y las necesidades sociales. También presentamos las diferentes posturas respecto al acceso a internet como un derecho humano o no, así como también cómo se reconoce este derecho en la Constitución Mexicana.
